Room descriptions About Owner-occupied apartments as a property transactionSince 2009, Sweden has had a form of tenure called owner-occupied apartment (ägarlägenhet), a form of tenure that has long been the most common in Europe. In an owner-occupied apartment you own and hold title to your apartment in exactly the same way as for a detached house. Unlike a detached house, which sits on its own plot of land delimited in the two-dimensional plane "on the ground", an owner-occupied apartment is located in an apartment building and the apartment's property is formed in the three-dimensional plane. Owner-occupied apartments are therefore often likened to a "townhouse in the sky". An owner-occupied apartment can be sold on, mortgaged and rented out without any special measures. You have full control over your owner-occupied apartment and can repaint, change the kitchen and do almost whatever you want in your apartment. You are also given the same opportunities to mortgage, encumber and transfer your owner-occupied apartment just as when you own a detached house or townhouse. It is also possible for a legal entity to purchase an owner-occupied apartment. An owner-occupied apartment is a property held with direct ownership. Just as with a detached house, the starting point is that you should have the right to independently dispose of your owner-occupied apartment property, for example by transferring, mortgaging and renting it out. A cooperative apartment (bostadsrätt), in turn, is only a right of use of an apartment. It is the housing cooperative that owns the property and the building in which the apartment is located. The right of use is tied to a share in a housing cooperative. In a housing cooperative, the member's right to dispose of the building and the apartments is limited in several respects. For example, special permission is usually required to sublet your cooperative apartment, some cooperatives do not approve legal entities as buyers, and for a transfer to be valid the acquirer must first be granted membership in the cooperative. Just as in a housing cooperative, the owner-occupied apartments in a building also have an association. This so-called joint property association manages land, maintenance and facilities outside your own property, such as stairwells, parking spaces and other common areas. It is each owner of an apartment who, together with their neighbours, owns and agrees on how the joint property is to be managed. In a housing cooperative, the cost of acquiring the property and the cost of constructing the cooperative's building have often originally been shared between the cooperative and the holders of the cooperative apartments. Therefore, housing cooperatives often have large loans. Interest and amortisation on these loans are paid by the members of the housing cooperative via the monthly costs. In an owner-occupied apartment, you bear the entire cost of the apartment, and therefore the fees to the joint property association are relatively low.
